Equality Court has found Malema guilty of h*te speech for statements in 2022

Julius Malema, Leader of the Economic Freedom Fighters (EFF), has been found guilty of hate speech for the 2022 statements he made in his speech at the EFF’s 3rd provincial People’s Assembly in the Western Cape by the Equality Court.

The statement concern events that happened two (2) years before where EFF members physically clashed with individuals at the Brackenfell High School, after allegations of racism connected to a private matric farewell during the COVID-19 pandemic.

At the time, the South African Human Rights Commission revealed, it had received multiple complaints as concerns the speech made by the EFF Leader.

At the time, the EFF was handed ten (10) days to denounce the statement which they never did.

The ruling is “an attack on the democratic space and the right to articulate revolutionary politics”, the EFF responded.

Via X, the EFF said: “We note the Court’s ruling as an attack on the democratic space and the right to articulate revolutionary politics. The language of revolution cannot be sanitised to comfort the sensitivities of those who continue to enjoy the fruits of colonial dispossession and have never experienced racial violence whatsoever.

“The real violence is the daily reality of landlessness, unemployment, and racism that black people endure.”
