According to bbc.com:
A Special Counsel report said he had kept secret documents related to military and foreign policy in Afghanistan after serving as vice-president until 2017.
But they said it would be difficult to convict Mr Biden as he comes across as an “elderly man with a poor memory”.
The White House hit back at that characterisation.
Forbes disclosed: “Department of Justice Special Counsel Robert Hur released a scathing report Thursday that found President Joe Biden “willfully” retained classified materials while a private citizen, but Biden’s age and alleged memory issues could make it hard to criminally convict him.”
