Supreme Court dismisses APM’s appeal, reserves Judgment In Atiku, LP’s Appeal

The judgment in the appeal by Alhaji Atiku Abubakar and the People’s Democratic Party (PDP) against the judgement of the Presidential Election Petition Court has been reserved by the Supreme Court of Nigeria.

The Presidential Election Petition Court judgment delivered on Wednesday 6 September, 2023 affirmed the victory of 2023 Presidential candidate of the ruling All Progressives Congress (APC), Bola Ahmed Tinubu, at the 2023 Presidential Election conducted on Saturday 25 February, 2023.

The Supreme Court also reserved judgment in the appeal by the Labour Party (LP), however, dismissed the Allied People’s Movement (APM).

The seven-member panel of the Supreme Court led by Justice Inyang Okoro made the announcement on Monday 23 October, 2023 after Counsels adopted their briefs of argument and made their final submissions.

Counsel to Alhaji Atiku Abubakar, Chris Uche, pleaded with the Court to grant the motion and allow their appeal, grant the prayers sought and disqualify Bola Ahmed Tinubu.

Counsel to respondents, Abubakar Mahmoud for the Independent National Electoral Commission (INEC); Wole Olanipekun for President Asiwaju Bola Ahmed Tinubu; and Akin Olujinmi for the All Progressives Congress (APC), urged the Supreme Court to dismiss both the motion and appeal for lacking merit.
